By downloading, accessing, or using the Buy'r mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree with these Terms, you must not use the App.

  • Personal Tools: Pantry management, shopping lists, ingredient filters, future meal plans and corporate information.

Our Mission: Buy'r is committed to cutting through greenwashing and corporate obfuscation to help consumers understand who profits from their purchases. We maintain editorial independence and hold brands accountable through investigative journalism.

3. Eligibility

You must be at least 13 years old to use Buy'r. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. User Accounts

4.1 Account Creation

  • You must create an account using email authentication to use Buy'r

  • You are responsible for maintaining the confidentiality of your account credentials

  • You agree to provide accurate, current, and complete information during registration

  • You are responsible for all activities that occur under your account

4.2 Account Security

  • You must immediately notify us of any unauthorized use of your account

  • We reserve the right to suspend or terminate accounts that violate these Terms

  • You may not transfer or share your account with others

5. User-Generated Content

5.1 Content You Submit

By submitting content to Buy'r (including product reviews, ratings, comments, feedback, or any other materials), you:

  • Grant Buy'r a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content

  • Represent that you own or have the necessary rights to submit the content

  • Represent that your content does not violate these Terms or any applicable laws

  • Understand that content may be used for App functionality, moderation, quality improvement, and editorial purposes

5.2 Content Standards & Prohibited Content

You agree NOT to submit content that results in:

Safety Violations:

  • Contains threats of violence, harassment, bullying, or intimidation

  • Promotes self-harm, suicide, eating disorders, or dangerous activities

  • Exploits, sexualizes, or endangers minors in any way

  • Doxes individuals by sharing private personal information without consent

Hate Speech & Discrimination:

  • Promotes hate, violence, or discrimination based on race, ethnicity, national origin, religion, caste, sexual orientation, gender identity, disability, or immigration status

  • Uses slurs, derogatory language, or symbols associated with hate groups

  • Advocates for the exclusion, segregation, or harm of protected groups

Illegal Activity:

  • Promotes, facilitates, or instructs illegal activities

  • Infringes intellectual property rights, trademarks, or copyrights

  • Contains spam, phishing attempts, or malware

  • Violates export control or sanctions laws

Misinformation:

  • Contains demonstrably false health or safety claims that could cause harm

  • Spreads election misinformation or manipulates civic processes

  • Misrepresents product safety or health information

Sexually Explicit Content:

  • Contains pornography, sexually explicit material, or nudity

  • Solicits sexual content or services

Commercial Abuse:

  • Is primarily advertising or spam for products/services unrelated to the reviewed product

  • Represents fake, paid, or incentivized reviews

  • Manipulates ratings or reviews for competitive advantage

Off-Topic Content:

  • Is unrelated to the product, brand, or topic being reviewed

  • Contains gibberish, nonsensical text, or low-quality contributions

5.3 Product Reviews Specific Guidelines

Acceptable Reviews Must:

  • Reflect genuine personal experience with the product

  • Focus on product quality, value, ingredients, company practices, or related consumer information

  • Express honest opinions, including criticism, when substantiated

  • Be between 10-500 characters in length

  • Relate to the specific product being reviewed

Unacceptable Reviews:

  • Personal attacks against individuals, employees, or other users

  • Reviews of products you haven't actually used

  • False or misleading information about product contents or effects

  • Coordinated review campaigns or review bombing

  • Reviews posted on behalf of competitors or motivated by financial incentives

Critical Speech We Protect: Buy'r explicitly allows and encourages critical analysis of:

  • Corporate ownership structures and business practices

  • Environmental and labor practices

  • Marketing claims versus product reality (greenwashing)

  • Ingredient quality and nutritional value

  • Value propositions and pricing fairness

Your right to criticize brands and corporations is fundamental to our mission. However, criticism must be factually grounded and not include prohibited content categories above.

6. Content Moderation System

Buy'r takes user safety seriously while respecting free expression. We employ an automated moderation system with human oversight for complex cases and appeals.

6.1 Automated Pre-Moderation

Input Filters:

  • Automated profanity filters scan all submissions before posting

  • Known offensive terms trigger immediate review and content hold

  • Content containing flagged terms is held pending automated moderation review

  • Users are notified when content requires additional review before publication

6.2 User Reporting System

Report Feature:

  • Every piece of user-generated content includes a "Report Inappropriate" button

  • Reports are categorized: Offensive Content, Harassment, Misinformation, Spam, Off-Topic, or Other

  • Users must select a reason and may provide additional context

  • Reporting users are informed that reports will be reviewed within 24 hours

Report Threshold & Automated Flagging:

  • Content receiving 5 or more user reports is automatically flagged for immediate AI moderation

  • Automated AI moderation immediately assesses flagged content against our Content Standards

  • AI moderation analyzes: hate speech, harassment, threats, explicit content, spam, and other violations as mentioned in section 5.2

  • The automated system takes action within 24 hours of the 5th report being submitted

6.3 AI-Powered Moderation

Automated Review Process: Buy'r uses artificial intelligence and machine learning systems to moderate reported and flagged content:

  • AI Analysis: Automated systems evaluate content against our Content Standards using natural language processing and pattern recognition

  • Context Assessment: AI considers context, intent, and severity when evaluating potential violations

  • Automated Actions: Clear violations are handled automatically by our AI moderation system

  • Speed: Automated moderation typically completes within minutes to hours, always within 24 hours

AI Moderation Actions: The automated system can take the following actions:

  1. Approve: Content complies with guidelines and remains published

  2. Remove: Content violates Terms and is automatically unpublished; user is notified via email

  3. Remove + Warn: Serious violation; automated warning issued about account standing

  4. Remove + Suspend: Repeated or severe violations; temporary account suspension issued

  5. Flag for Human Review: Edge cases or appeals are escalated to human moderators

6.4 Human Oversight & Appeals

When Humans Review: While the majority of moderation is handled by our automated AI systems, human moderators review:

  • Appeals: Users who disagree with automated moderation decisions (see Section 7)

  • Complex Cases: Content flagged by AI as requiring human judgment

  • Policy Updates: Reviewing patterns to improve automated moderation accuracy

  • Severe Violations: Child safety, credible threats, and illegal content reports

Human Review Commitment:

  • Appeals are reviewed by human moderators within 5-7 business days

  • Human moderators have final authority over automated decisions

  • Moderators evaluate context, intent, and tone that AI may miss

6.5 Transparency About AI Moderation

How AI Moderation Works:

  • AI models are trained on our Content Standards and thousands of examples

  • The system identifies patterns associated with prohibited content

  • AI does not have subjective bias but follows programmed guidelines

  • Automated decisions are consistent and apply rules equally to all users

AI Limitations:

  • AI may occasionally make errors in judgment (false positives or false negatives)

  • Context-dependent speech may be misinterpreted by automated systems

  • This is why we provide a robust appeals process for all automated decisions

You Have Rights:

  • You may appeal any automated moderation decision

  • Human review is available for all disputed removals

  • We continuously improve our AI systems based on feedback and appeals

6.6 Moderation Response Times

  • Reported content: Automated review within 24 hours of report submission

  • 5-report threshold: Immediate AI moderation upon reaching threshold

  • High-priority reports (threats, illegal content, child safety): Immediate automated response

  • Appeals: Human review within 5-7 business days

7. Appeals Process

7.1 Content Removal Appeals

If your content is removed and you believe the decision was made in error:

  1. Submit an Appeal: Contact support@buyrapp.com within 30 days of removal

  2. Include Information:

    • Your user ID or email address

    • Content ID or description of removed content

    • Explanation of why you believe removal was inappropriate

    • Any supporting evidence or context

  3. Review Timeline: Appeals are reviewed within 5-7 business days

  4. Appeal Decision: You will receive a written explanation of the appeal outcome

  5. Final Decision: Appeal decisions are final; repeat appeals for the same content will not be reviewed

7.2 Account Suspension/Ban Appeals

If your account is suspended or banned:

  1. Submit an Appeal: Contact appeals@buyrapp.com within 30 days

  2. Include Information:

    • Your user ID and registered email

    • Explanation of circumstances

    • Commitment to comply with Terms going forward

  3. Review Process: Account appeals are reviewed by senior moderation staff

  4. Outcome: Accounts may be reinstated, suspension extended, or ban upheld

Note: Bans for child safety violations, illegal activity, or severe harassment are typically permanent and not subject to appeal.

8. Intellectual Property

8.1 Buy'r Content

All content created by Buy'r, including brand spotlights, articles, research, quizzes, app design, logos, and trademarks, is owned by Buy'r and protected by copyright, trademark, and other intellectual property laws.



Editorial Content License:

  • Brand spotlights and investigative articles are licensed for personal, non-commercial use

  • You may share links to Buy'r content but may not reproduce articles in full elsewhere

  • Company logos and images are used for editorial and journalistic purposes under fair use principles



Editorial Spotlight Display:

  • Dashboard spotlight content is randomly selected from our library of family-owned, founder-owned, and employee-owned company spotlights

  • Spotlight display rotation is algorithmic and not based on promotional consideration, paid placement, or Buy'r's endorsement

  • Featured spotlights do not constitute recommendations, endorsements, or Buy'r's opinion about any specific brand or company

  • Buy'r does not accept payment or promotional consideration for spotlight placement

  • All spotlight content is created independently for educational and informational purposes

8.2 Third-Party Content

Buy'r displays product information, images, and brand logos from third-party sources:

Product Data Sources:

  • OpenFoodFacts (Open Database License)

  • Go-UPC API (licensed)

  • User-contributed product information

Brand Logos & Images:

  • Company logos and images are used for identification and commentary purposes

  • Usage complies with fair use principles for journalism and consumer education

  • We do not claim ownership of third-party trademarks or copyrighted materials

Attribution:

  • Product data is attributed to respective sources where applicable

  • Brand logos are property of their respective owners

  • Images are used for editorial purposes in connection with investigative content

8.3 Copyright Complaints (DMCA)

If you believe content in Buy'r infringes your copyright:

DMCA Notice Requirements:

  1. Identification of the copyrighted work claimed to be infringed

  2. Identification of the infringing material and its location in the App

  3. Your contact information (address, phone, email)

  4. A statement of good faith belief that use is not authorized

  5. A statement that the information is accurate and you are authorized to act

9. Subscription Services & Payments

9.1 Subscription Tiers

Buy'r offers a sliding-scale subscription model:

  • Free Tier ($0/month): Product scanning, Shopping List (1), Limited Spotlight Information, Pantry Items (20), Can Rate (After Physical Requirements) but cannot Review, Limited Filter Presets

  • Premium Tier ($5/month) ($50/year): Product scanning, Shopping List (Unlimited), Full Spotlight Information, Pantry Items (Unlimited), Can Rate & Review (After Physical Requirements), Custom Filters & Presets

  • Supporter Tiers ($10-$20/month): All Premium Features + Donation towards our hard work and efforts to the mission promoting transparent shopping

9.2 Payment Terms

  • Subscriptions are billed monthly through Apple App Store or Google Play Store

  • Payment is processed through your app store account

  • Subscription automatically renews unless canceled at least 24 hours before renewal

  • Changes to subscription pricing will be communicated 30 days in advance

9.3 Refund Policy

  • Subscription fees are non-refundable

9.4 Cancellation

  • You may cancel your subscription anytime through your app store account settings

  • Cancellation takes effect at the end of the current billing period

  • You retain access to premium features until the end of the paid period

  • No partial refunds for mid-period cancellations

10. Privacy & Data Protection

Your privacy is paramount. Please review our separate Privacy Policy for detailed information about:

  • We do NOT sell user data to third parties

  • We do NOT use invasive tracking or behavioral advertising

  • We minimize data collection to what's necessary for App functionality

  • You may request data export or deletion at any time

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

Buy'r makes no warranties that:

  • The App will be uninterrupted, timely, secure, or error-free

  • Product information is complete, accurate, or up-to-date

  • User-generated content is accurate or reliable

  • The App will meet your specific requirements

Product Information Accuracy:

  • We source product data from third-party databases and user contributions

  • Product information may be incomplete, outdated, or contain errors

  • Always verify critical information (allergens, ingredients) with product packaging

  • Buy'r is not responsible for decisions made based solely on App information

Editorial Content:

  • Brand spotlights and articles represent investigative journalism and editorial opinions

  • We strive for accuracy but cannot guarantee all facts are error-free

  • Editorial content is protected opinion and analysis, not professional advice



12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUY'R SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages

  • Loss of profits, revenue, data, or business opportunities

  • Service interruptions or data loss

  • User-generated content or third-party conduct

  • Decisions made based on App information

  • Allergic reactions or health issues related to products

  • Damages exceeding the amount paid to Buy'r in the past 12 months

User Responsibility:

  • You are responsible for verifying product information for safety-critical decisions

  • Always check product labels for allergen and ingredient information

  • Consult healthcare professionals for medical or dietary advice

  • Use the App at your own risk

13. Indemnification

You agree to indemnify, defend, and hold harmless Buy'r, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the App

  • Your violation of these Terms

  • Your violation of any third-party rights, including intellectual property or privacy rights

  • Content you submit to the App

  • Your violation of any applicable laws or regulations

14. Termination

14.1 Termination by You

You may stop using the App and delete your account at any time by:

  • Contacting support@buyrapp.com to request account deletion

  • Uninstalling the App from your device

14.2 Termination by Buy'r

We may suspend or terminate your access to the App immediately, without notice, for:

  • Violation of these Terms or Community Guidelines

  • Fraudulent, abusive, or illegal activity

  • Impersonation of others or misrepresentation

  • Repeated submission of prohibited content

  • Attempting to manipulate ratings, reviews, or App functionality

  • Any conduct that harms Buy'r's reputation or other users

14.3 Effect of Termination

Upon termination:

  • Your right to access the App immediately ceases

  • User-generated content may be retained for legal or operational purposes

  • Subscription fees are non-refundable unless required by law

  • Sections that by nature should survive (Intellectual Property, Disclaimers, Limitation of Liability, Indemnification) remain in effect

15. Changes to Terms

Buy'r reserves the right to modify these Terms at any time. Changes will be effective when:

  • Posted within the App with a revised "Last Updated" date

  • Communicated via email to registered users (for material changes)

  • Continued use of the App constitutes acceptance of modified Terms

Your Rights:

  • You will be notified of material changes at least 30 days before they take effect

  • If you disagree with changes, you may stop using the App and delete your account

  • Continued use after changes indicates acceptance

16. Governing Law & Dispute Resolution

16.1 Governing Law

These Terms are governed by the laws of Wyoming, without regard to conflict of law principles.

16.2 Informal Resolution

Before filing any legal claim, you agree to contact us at legal@buyrapp.com to attempt to resolve the dispute informally. We will work in good faith to resolve disputes within 60 days.

16.3 Arbitration Agreement

You may not assign or transfer these Terms. Buy'r may assign these Terms in connection with a merger, acquisition, or sale of assets.

17.5 Force Majeure

Buy'r is not liable for delays or failures in performance resulting from causes beyond our reasonable control, including acts of God, war, terrorism, pandemic, internet failures, or government actions.

17.6 Language

These Terms are provided in English. Translated versions are for convenience only; the English version controls in case of conflict.

Buy'r makes no warranties that:

  • The App will be uninterrupted, timely, secure, or error-free

  • Product information is complete, accurate, or up-to-date

  • User-generated content is accurate or reliable

  • The App will meet your specific requirements

Product Information Accuracy:

  • We source product data from third-party databases and user contributions

  • Product information may be incomplete, outdated, or contain errors

  • Always verify critical information (allergens, ingredients) with product packaging

  • Buy'r is not responsible for decisions made based solely on App information

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUY'R SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages

  • Loss of profits, revenue, data, or business opportunities

  • Service interruptions or data loss

  • User-generated content or third-party conduct

  • Decisions made based on App information

  • Allergic reactions or health issues related to products

  • Damages exceeding the amount paid to Buy'r in the past 12 months

User Responsibility:

  • You are responsible for verifying product information for safety-critical decisions

  • Always check product labels for allergen and ingredient information

  • Consult healthcare professionals for medical or dietary advice

  • Use the App at your own risk

13. Indemnification

You agree to indemnify, defend, and hold harmless Buy'r, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the App

  • Your violation of these Terms

  • Your violation of any third-party rights, including intellectual property or privacy rights

  • Content you submit to the App

  • Your violation of any applicable laws or regulations

14. Termination

14.1 Termination by You

You may stop using the App and delete your account at any time by:

  • Contacting support@buyrapp.com to request account deletion

  • Uninstalling the App from your device

14.2 Termination by Buy'r

We may suspend or terminate your access to the App immediately, without notice, for:

  • Violation of these Terms or Community Guidelines

  • Fraudulent, abusive, or illegal activity

  • Impersonation of others or misrepresentation

  • Repeated submission of prohibited content

  • Attempting to manipulate ratings, reviews, or App functionality

  • Any conduct that harms Buy'r's reputation or other users

14.3 Effect of Termination

Upon termination:

  • Your right to access the App immediately ceases

  • User-generated content may be retained for legal or operational purposes

  • Subscription fees are non-refundable unless required by law

  • Sections that by nature should survive (Intellectual Property, Disclaimers, Limitation of Liability, Indemnification) remain in effect

15. Changes to Terms

Buy'r reserves the right to modify these Terms at any time. Changes will be effective when:

  • Posted within the App with a revised "Last Updated" date

  • Communicated via email to registered users (for material changes)

  • Continued use of the App constitutes acceptance of modified Terms

Your Rights:

  • You will be notified of material changes at least 30 days before they take effect

  • If you disagree with changes, you may stop using the App and delete your account

  • Continued use after changes indicates acceptance

16. Governing Law & Dispute Resolution

16.1 Governing Law

These Terms are governed by the laws of Wyoming, without regard to conflict of law principles.

16.2 Informal Resolution

Before filing any legal claim, you agree to contact us at legal@buyrapp.com to attempt to resolve the dispute informally. We will work in good faith to resolve disputes within 60 days.

16.3 Arbitration Agreement

You may not assign or transfer these Terms. Buy'r may assign these Terms in connection with a merger, acquisition, or sale of assets.

17.5 Force Majeure

Buy'r is not liable for delays or failures in performance resulting from causes beyond our reasonable control, including acts of God, war, terrorism, pandemic, internet failures, or government actions.

17.6 Language

These Terms are provided in English. Translated versions are for convenience only; the English version controls in case of conflict.
